Sir,

Red 16 NOV OC

Supreme Court,
Hongkong, 12th October, 1906.

I have the honour to state for the information of Your Excellency, that the Attorney General has expressed a very strong opinion that under Section 11 of Ordinance 3 of 1873, I cannot act as Attorney General without resigning my office as Judge and that if I do, such office is ipso facto avoided and my pay would cease.

Under these circumstances I trust Your Excellency will allow me to withdraw my promise as I do not feel inclined to run any risks and I do not think that Your Excellency would expect me to do so. I am sorry to have occasioned this trouble but I had not thought of the point.

I have etc.,

(sd.) Alfred G. Wise,
Puisne Judge.

His Excellency
Sir Matthew Nathan, K.C.M.G.,
Governor,
